Is this pond on private or public property? Is it posted?

If it is public then you have a right to be there, unless it is posted.

If it is private, you can only be charged with trespassing if you fail to leave AFTER being asked to leave, or if it is posted. And the charge would be trespassing, not loitering.

I derive this from my knowledge on photographers rights.
