Glen, I'm fairly sure I recall reading that depths are relative to the Earth's surface, or, more accurately, the computed "geoid." Depths above the geoid would be very rare. I don't believe, for instance, that harmonic tremor, which comprises the bulk of seismic activity in volcanic conduits, shows up in any catalogs that we see.
