I'm fairly sure that what is prohibited is charging $ for predicting earthquakes absent a proper license. That is what GeoForecasters was accused of and prohibited from doing. Seems like a reasonable application of existing law to me.

The First Amendment to the constitution would prevent a law disallowing the prediction of earthquakes from being upheld. Iben Browning would still be allowed to make his prediction today.
