Hi Don,

I like this statement, "Nobody telling them it's coming. This is incredible!," Fagan said."

This is interesting because if one is looking at earthquakes and awareness of possible results following one, this would lead one to believe that we could have a case of "Victims vs the USGS" for failure to notify residents of San Simeon that the area is prone to moderate earthquakes every 50 years. We do have a direct statement from a USGS scientist who said after the earthquake that the residents "should have known" the quake was going to occur because of this faults behavior. However, "failure to advise" might be grounds for a suit. But,the statute of limitations has probably already run by now.

Though I would like to think this is yet another frivilous lawsuit, about three years from now we'll know the results IF the case is allowed to be filed and motions support grounds for suit. There were never any implied warranties to any residents of the Indonesia or Indian areas that anyone was going to provide any type of warning service, so that's gonna be a hard nut to crack.

Interesting though.
